Quad bike manufacturers walk out of safety working group

In early 2010, Australia’s Heads of Workplace Safety Authorities (HWSA) established a trans-Tasman working party to look at the safety issues of quad bikes, often called all-terrain vehicles.  The working group is in the final stages of its report and a major motorcycle industry representative has not liked the findings and has apparently withdrawn from the working group.  A report on the increasing tensions was published in  this week’s The Weekly Times.  SafetyAtWorkBlog has been told that the quad bike industry representative has walked out in protest.

Let’s look at what HWSA said about the working group in May 2010:

“HWSA Chair, John Watson, said every farming fatality leads to immeasurable suffering in close-knit rural communities and these figures are not acceptable.
“The working group is expected to deliver solutions to safety problems associated with use of quad bikes on farm properties and raise awareness of practical risk controls,…
“The group will look at issues that include design, safety equipment, training and instruction, aftermarket accessories, safe use and point of sale,….
“The joint program of work will be delivered through an Industry Solutions Program where industry and regulators work together to address high risk safety issues – an initiative that has successfully provided practical solutions to a number of issues across many industries.
“The working group is focused on producing tangible and sustainable safety outcomes across the farming and agricultural industry where quad bikes are commonly used….”
Of significance in that media release is that Chief Executive of the Federal Chamber of Automotive Industries (FCAI) Andrew McKellar said

“It is our objective that all quad bike users are well informed of the manufacturer’s recommendations in relation to the safe use of these vehicles…”

The sticking point in the working group was, according to The Weekly Times, that

“”…the committee was expected to back the recommendation to “consider fitting an anti-crush device”, the strongest position yet for roll-over protection.”

Transocean executives gain safety bonuses

News that Transocean are awarding their executives substantial safety bonuses has the internet aflame with outrage.  Certainly it seems hard to justify the bonuses given after the death of 11 workers and the damage to the local environment, economy and community but the action will also affect safety management.

 Safety management is increasingly relying on statistics to identify performance levels.  Transocean’s actions illustrate that some statistics bear little relation to reality or, at least, the real-world context of its operations.

AFP  quotes Transocean as reporting to the US Securities and Exchange Commission that:

“Notwithstanding the tragic loss of life in the Gulf of Mexico, we achieved an exemplary statistical safety record as measured by our total recordable incident rate and total potential severity rate” Continue reading “Transocean executives gain safety bonuses”

“We will trust but we will verify” – upcoming lessons from the Gulf of Mexico

The mass media is full of reports on legal action being taken on behalf of shareholders in BP over the continuing oil spill from the former Deepwater oil rig in the Gulf of Mexico.

An Australian video report was broadcast on 25 May 2010 and a composite article has appeared in The Australian on 26 May 2010 as well as elsewhere. Many outlets are mentioning the law suit (Southeastern Pennsylvania Transportation Authority and Robert Freedman v Anthony B Hayward et al, Court of Chancery for the state of Delaware, No. 5511) but no details of the suit are publicly available at the moment.

Although safety is mentioned as one of the bases for the suit, it is likely that environmental impact will get prominence over occupational safety and that impact on stock value will be of the most concern.   The shareholder outrage mentioned in some of the articles seems to focus mostly on the financial impact on BP share value rather than any moral outrage on environmental impact or dead and injured workers.

Prominent OHS lawyer to facilitate workers’ compensation reform discussions

SafetyAtWorkBlog has been able to confirm the rumour that Barry Sherriff, a prominent Australian OHS Lawyer who recently joined Norton Rose, has been contracted to facilitate a series of exclusive forums on the reform of Australia’s workers’ compensation system.

Sandman lecture online

In November 2009, Peter Sandman delivered the Berreth Lecture at the annual conference of the National Public Health Information Coalition (NPHIC).  Significantly Sandman was asked not to present on risk communication but about his experiences in risk communication and how he came to prominence in the field.

The NPHIC has made the 65-minute video of his lecture available on-line. Sandman has the audio available through his website. The speech notes are also available but, as is his wont, Sandman diverges from the “script” frequently.

Independent Aussie politician forecasts “near riots” on OHS

Rob Oakenshott is an independent politician in the New South Wales parliament,  He was formerly a representative of the National Party.  Oakenshott is one of the first Australian politicians who are not directly involved in the program of OHS law  harmonisation to raise any concerns.

What spurred him to speak was a recent case in the High Court of Australia centring around NSW’s absolute OHS duty of care.  Comments from the Allens Arthur Robinson newsletter say:

“The matter will present an opportunity for the court to determine whether the interpretation of the duties under the OHS Act is so restrictive that it makes it impossible for an employer to comply with them and practically removes the benefit of the statutory defences.  The issue of the difficulty of complying with the legislation is something that the defendants have submitted runs counter to the rule of law and the Constitution.”

Oakenshott stated in a media release (not yet available on his website):

“I am also concerned that aspects of NSW state legislation such as the absolute liability elements are being considered by the Federal Government,” he said. “Having been involved in state politics for fifteen years, I can assure the government they will have near riots on the streets from the small business community of Australia if they mirror NSW legislation in the quest for harmonious national laws.”

This would be the first time that OHS would ever have raised the passion of Australian small businesses to this extent.   A survey produced for the ACTU (considered to be representative of the general population by the research company) quoted the following statistics:

67% believe that workplace safety is important, but only 40% see it as “very important”.

Panic in disaster planning

Three years ago I had the privilege of arranging for Dr Lee Clarke of Rutgers University to attend the Safety in Action Conference in Australia.  Lee had a book out at the time, Worst Cases, and spoke about the reality of panic.  Lee’s studies have continued and are, sadly, becoming more relevant.

Recently, Rutgers University posted a video interview with Lee on Youtube.

Shortly after the World Trade Center collapse in 2001, I asked Lee to write something about the event from his experience and perspective.  He wrote a piece for a special edition of Safety At Work magazine.  The article has been available through his website for some time and is now available through here by clicking on the image below.

I strongly recommend Lee’s books.  As he says in the video, they’re quite fun, in a sad sort of way.
