Professor Michael Quinlan on Jeff Shaw’s legacy

The Australian newspaper on 12 May 2010 published an article that is an example of the type of article on the passing of former New South Wales Attorney-General Jeff Shaw that SafetyAtWorkBlog expressed concerns over.  For most of the article Shaw’s alcoholism is the focus yet we should not judge a person only by their flaws but by their achievements.

SafetyAtWorkBlog interviewed Professor Michael Quinlan who was closely involved in some of the law reform work that Jeff Shaw instigated in the 1990s when he was the Attorney-General.

Important OHS law reformer, Jeff Shaw, dies

Around 15 years ago, occupational health and safety law in New South Wales looked exciting.  The NSW Standing Committee on Law & Justice was  investigating OHS, and not just the laws.  There was a potential for the inquiry to make New South Wales a leader in innovation in this sector.

On 11 May 2010, the news broke that a leading supporter for the review, Jeff Shaw, had died.  Although his legal career ended in controversial fashion, Shaw’s activities in relation to industrial relations and OHS were notable.  SafetyAtWorkBlog looks briefly at Jeff Shaw’s OHS legacy. The struggle to achieve cultural change on OHS

In 2008, a New South Wales Parliamentary Committee reported to the Government on problems with that State’s Ambulance Services.  The problems included bullying, harassment and a dysfunctional management.  A review into the Ambulance Services progress on the recommendations two years later has found :

“…the general feedback received from ambulance officers is that despite the new initiatives, little has changed, and significant management and cultural problems remain within the Service. While awareness of the Service’s new policies and initiatives appears to be high, adherence to and application of the policies – particularly by Ambulance managers – appears to be low, or at best, varied.” Continue reading “The struggle to achieve cultural change on OHS”

Union view of OHS harmonisation and data on the social cost of workplace safety

The national OHS Officer of the Australian Manufacturing Workers Union, Deborah Vallance, provided her perspective on the tweaking of Australia’s OHS laws to the StickTogether radio program on 25 April 2010.  (The interview is at the 16 minute mark in the podcast)

Vallance says that the complexity and overlap of laws is often overstated but that there are benefits for licencing systems related to workplaces.  She casts doubt on the significance of the reforms leading to a “seamless economy” regularly spruiked by government ministers. Inter-related issues of workplace bullying

Most of the workplace bullying attention in Australia in recent years has focussed on the white-collar industries and the relationship to stress, workload, harassment and policies for respect.   A case reported in the The Age newspaper on 29 April 2010 about bullying in a door frame company is reflective of apprentice bullying cases of over a decade ago but also illustrates the potential complexity of this workplace hazard. Unionists express anger at Australia’s approach to OHS on Workers’ Memorial Day

Some days, politics should be kept in the background.  Increasingly the International Day of Mourning is being used as a political platform, principally by the union movement.  But this is discomforting and a little like anti-war protests during ANZAC Day, as happened several decades ago.

International Day of Mourning, or Workers’ Memorial Day, as it is also known, should be a time of reflection.  There is no doubt that there is a political element to wortkplace safety and the deaths of workers but it is hard to remember the dead, look at the memorials and the floral tributes when a tannoy is shouting to a unon protest rally.

This was part of the scene outside the Trades Hall in Melbourne on 28 April 2010.  Thousands of construction workers used the memorial as the starting point for a march to the offices of the Deputy Prime Minister, Julia Gillard. ACTU industrial officer is new WorkSafe executive

SafetyAtWorkBlog has been informed that Cath Bowtell has been appointed the new executive director of WorkSafe Victoria.  Bowtell’s name may be familiar to some Australians due to her recent contest to be the next President of the Australian Council of Trade Unions (ACTU).
