Australian OHS experts call for a single OHS regulator and a unified insurance system

Some of Australia’s top work health and safety experts have stressed, to Safe Work Australia, the need for a single national OHS regulator.  Many also called for a radical overhaul of workers’ compensation and insurance structures to achieve a combined insurance/compensation similar to that of New Zealand, the Accident Compensation Commission (ACC).

These calls were made in a  whole day workshop, conducted by Safe Work Australia on 30 August 2011, on the development of the next ten-year national OHS strategy.  This was the latest of around ten consultative sessions whose notes will be summarised and posted online.  The notes from an earlier seminar list the following discussion topics:

  • “The need to focus on work health and safety prevention.
  • Engagement with target groups and industries to ensure advice and support is relevant to enable them to effectively respond to hazards.
  • Engineering hazards out through good design.
  • Influencing the supply chain inside and outside Australia.
  • Prioritising key work health and safety hazards and focusing national attention.
  • Creating opportunities for innovation in work health and safety particularly within the regulatory framework.
  • Enhancing the culture of safety leadership (promoting highly reliable organisations).
  • The importance of safety culture.
  • Enhancing the capability of workers to return to work following accident or illness.
  • Influencing or assisting academia to undertake research – focusing on intervention effectiveness.
  • Developing a shared communication strategy to promote the new principles of the new Strategy.”

These echo many of the comments in today’s seminar and illustrate what was a major missed opportunity.  The theme of today’s workshop was to imagine what OHS (or work health and safety or work health safety & environment, as some suggested) will be like in 2022 but there were few futuristic suggestions.  This was the opportunity to extend some of the practices currently undertaken by ten years. Workplace bullying statistics remain muddy

A recent article on workplace bullying by the CEO of Diversity Council Australia, Nareen Young, is a good introduction to the issue but, as with many other articles on the issue, the content requires careful consideration.

One statistical resource used on workplace bullying articles is the very important and influential March 2010 Productivity Commission (PC) report – Performance Benchmarking of Australian Business Regulation: Occupational Health & Safety.  Predominantly, this report lumps together “harassment”, “occupational violence”, and “fatigue” with “workplace bullying” under the term “psychosocial hazards”.  This means it is impossible to extrapolate data from any specific workplace issue in this category, however the PC report does devote some sections of Chapter 11 specifically to bullying, but even then the statistics are tricky.

Fatigue management is getting clearer but is competing for attention

As a discipline for study, fatigue still seems to be in its early days and this presents a challenge for safety professionals and researchers.  Everyone knows what fatigue is because at some time we all suffer it, but try to define it and it is different things to different people.

Transport Safety Victoria (TSV), a division of the Department of Transport, brought together three speakers on the issue of fatigue management in early August 2011.  The public seminar provided a good indication of the complexity of the occupational issue of fatigue management.

The first revelation in the seminar came from Dr Paula Mitchell who stressed that fatigue cannot be self-assessed.  Researchers are struggling to create a widely accepted indicator for fatigue.  There is no blood alcohol reading device for fatigue and the Independent Transport Safety Regulator in July 2010 expressed caution on the application of the bio-mathematical fatigue model. Quad bike safety is showing a political shift

A young boy has died in a quad bike incident on an Australian farm last weekend.  What the boy was doing at the time of the incident is unclear and whether the quad bike was a work vehicle or recreational is also unclear, but the current sensitivities of the issue of quad bike safety have raised media attention once more.

In this week’s edition of The Weekly Times, the motorcycle manager of the Federal Chamber of Automotive Industries, Rhys Griffiths, seems uncertain of the type of safety measures being considered for quad bikes by manufacturers.  He is reported as saying

“…. research and development spending and direction was a “closely guarded secret of each manufacturer”.

“My guess is they may be spending money on things like active suspension, which helps the stability of the ATV. But a roll bar or crush bar is probably not under development.”

Since quad bike safety advocates began producing robust research to add to the existing safety evidence, the FCAI seems to have been on the back foot a little by reacting instead of proposing change.   Continue reading “Quad bike safety is showing a political shift”

Fatigue dispute illustrates ideological clash

The Australian newspaper reports today (26 July 2011) of a clash between the Construction Forestry Mining & Energy Union (CFMEU) and BHP Billiton over fatigue management.  Fatigue management is one of the workplace hazards scheduled for a draft code of practice under the OHS harmonisation process.

The CFMEU believes that the current mining-related guidance  is inadequate.

“The Construction Forestry Mining and Energy Union says the government buckled under industry pressure and abandoned plans for binding industry standards that would minimise the risk of workers doing successive 12-hour shifts and then driving long distances on public roads.”

The flaw in the CFMEU’s campaign is that it has been selective in its choice of fatigue documentation.  Looking at the industry sector rather than the hazard or risk limits the hazard control options.  In the current case the CFMEU is not acknowledging many of the fatigue guidancesand documents that are available from Workplace Health and Safety Queensland or from some of the other States and even from overseas as this Safe Work Australia document from 2006 shows.

In fact the narrow selection of guidance in this instance makes a strong case for greater collaboration in the development of information across industry sectors and State jurisdictions – one of the aims of harmonisation. Continue reading “Fatigue dispute illustrates ideological clash”

WorkSafe Victoria provides insight into bullying investigations

It has been known for some time that OHS regulators struggle with handling reports of workplace bullying.  Investigation of these hazards requires new inspectorate skills and take considerable time.  Investigations of bullying involve people and this is always more involved than inspecting a missing machine guard or assessing the operation of a forklift.  However, in an article in the Fairfax media on 24 July 2011 WorkSafe Victoria provides some surprising statistics that show a new perspective on workplace bullying and a contrast to recent statistics from Comcare.

The most significant statistic is that, of the 6000 reports of workplace bullying within the last 12 months, only 600 warrant further investigation and, of those, around 60 generate a physical inspection of the workplace.  These statistics may indicate a range of issues:

  • OHS regulators require greater number of inspectors.
  • Workplace bullying is being critically misunderstood by the community.
  • Workers are confused about where to report their treatment and choose WorkSafe as the agency with the highest profile for workplace issues.
  • Other workplace-related agencies and authorities, such as Fair Work Australia and the Australian Human Rights Commission, need to raise their profiles on this issue.
What is missing from the WorkSafe statistics above is the next level of intervention.  What action is being taken by the inspector?  Will prosecutions occur?  Are improvement notices applied?  There may be just as wide a gap between the 60 inspections and an appearance in court.

Back support devices don’t work but new designs should be investigated

In 2009 Australian OHS regulators made the definitive statement on the use of back belts.  The guidance stated that:

  • Back belts don’t reduce the forces on the spine
  • Back belts don’t reduce the strain on muscles,tendons and ligaments
  • Back belts do nothing to reduce fatigue or to increase the ability to lift
  • Back belts are like holding your breath when lifting
  • Back belts can increase blood pressure and breathing rate
  • Back belts don’t reduce the chance of injury or reduce back pain.

This was a terrific example of evidence-based safety.  But this does not mean that the use of back belts should not be reconsidered if there is new evidence or new back belt designs.

One SafetyAtWorkBlog reader has drawn our attention to a new type of back support, The Tolai All Purpose Back Support.  In no way does this blog support this particular device.  In fact, there is a strong argument against the widespread use of such devices as these may advocate the reliance on PPE (personal protective equipment) rather than a higher order of control, such as task redesign, which would result in a more sustainable solution.
