Psychological advice on handling people that is broadly applicable

The latest edition of Lawyers Weekly includes an article ostensibly about managing bullies in the legal profession written by psychologist, Dr Chris Day.  The article provides some general tips, though, that are useful to any of us who need to make decisions refreshingly she reflects two options that I offer to my OHS clients on safety matters that do not include bullying.  Dr Day says that any problem can be solved by these actions

  1. “Leave…
  2. Change the situation…
  3. Accept the situation…
  4. Do nothing….”

Leave and change are included in the OHS Hierarchy of Control under different terminology.  Doing nothing is advice that few OHS consultants will give but is a strategy that many small businesses apply.  Their risk management strategy is to press their luck and in some cases this can work.   Continue reading “Psychological advice on handling people that is broadly applicable”

Social change through worker dignity

The need for food parcels for those on workers’ compensation seems to continue in South Australia according to a 3 July 2010 report in Adelaide Advertiser.  SafetyAtWorkBlog mentioned the service being offered by Rosemary Mackenzie-Ferguson and others in March 2010.

There are many areas of society that are supported by privately provided social services and this situation is likely to persist but just as soup kitchens illustrate a problem of poverty, so the food service mentioned above indicates a problem with workers’ compensation.

As each Australian state reviews its workers’ compensation laws ahead of a national harmonisation, it seems absurd to focus on the laws but not on the social impacts of those laws.  It is common to refer to a “whole-of-government” approach to issues but “whole-of-society” seems to be a slower concept to embrace.

Much is being made in Australia’s OHS harmonisation process of the need to look at the enforcement policies that support new legislation.  There is also a (flawed) reliance on Courts to provide clarity to the legislation rather than producing clear laws in the first place.  But rarely does government look beyond the law, the Courts, or the enforcement policies to assess the potentially negative social impacts of the OHS and workers’ compensation laws. Apprentice set on fire, bully gets $5k penalty

Most of the Australian media covered the prosecution of the latest of three young men who set fire to a work colleague during their apprenticeships.

As the case was heard in a Magistrates’ Court, the only sources of information on the case are a couple of original media reports and the statement from WorkSafe Victoria which says:

“Matthew Lever, 23, was the third apprentice to be prosecuted after a January 2008 incident where three apprentice mechanics ignited brake-cleaning fluid which they sprayed on another apprentice….

The Ringwood Magistrates’ court today [1 July 2010] convicted Matthew Lever on three charges under the Occupational Health and Safety Act and fined him $5,000. The two other apprentices were convicted on health and safety charges in December 2008, and also fined $5,000 each.” [link added]

WorkSafe says it is “currently investigating a similar incident which occurred in Dandenong in March, where two apprentice mechanics suffered burn injuries after allegedly igniting brake fluid.” Continue reading “Apprentice set on fire, bully gets $5k penalty”

Another Australia emergency organisation faces bullying claims

Emergency service organisations, like the military, are susceptible to accusations of bullying due to the hierarchical command structure on which they are based. 

For decades this type of structure has been seen as a requirement for efficient emergency response or other activities under tight timelines and high expectations.  It would not take much to perceive one’s supervisor saying “move it, move it, move it” or similar, over time as a repeated insult and, being repeated, an instance of bullying.

The Australian Broadcasting Corporation (ABC) is reporting on claims by the former president of the Metropolitan Fire Brigade Board (MFB), Adrian Nye, who was stood down in April 2010.  The ABC says Nye has accused the MFB of having a culture of bullying. 

CEO Graeme Fountain has called in KPMG to investigate Nye’s claims.

There is sufficient evidence to suggest that the hierarchical command structure is no longer compatible with contemporary expectations of respect, health, safety or wellbeing.  Continue reading “Another Australia emergency organisation faces bullying claims”

Australian roundtable podcast on workplace bullying

On 21 May 2010, Boardroom Radio (BRR) released a podcast on workplace bullying that includes opinions from some worthy speakers.

Andrew Douglas, Managing Director at Douglas LPT;

Wayne Blair, Fair Work Australia Commissioner;

Gail Hubble, Barrister; and

Anna Palmer, HR Consultant, at Provenio Consulting

Harmonising bullying terminology extends well beyond OHS

In May 2010, Workplace Health & Safety Queensland uploaded a Workplace Harassment Assessment Tool.  The curious element to the information is that Queensland does not mention the word “bullying” even though the assessment criteria cover this hazard.

As Australia moves to harmonised legislation on workplace safety issues, the harmonisation of terminology is going to be important and probably subject to lively discussion.   Continue reading “Harmonising bullying terminology extends well beyond OHS”

Workplace bullying – more of the same

In November 2009, a New South Wales Government committee reported on issues concerning bullying.  Much of it concerned school-related bullying but there was some evidence and recommendations concerning workplace bullying of apprentices and trainees.  On 12 May 2010, the Government  responded to the recommendations.

By and large, the responses to the work-related bullying recommendations are uninspiring with the Government exploiting the loopholes left for it in the recommendations.  For instance, the Committee recommended:

“That the NSW Attorney General examine the adequacy of the existing legal framework for bullying related offences, and identify any legislative changes that could enhance the legal protection provided to victims of bullying and cyberbullying.”

The long-winded response is that there is a lot of activity but with no definitive aim.  But then the recommendation did not call for results, only “examine” and “identify” opportunities.

The Committee report is more interesting than the Government’s response due to the access to various submissions on school, work and cyber-bullying but it has quickly become only of historical interest and added to the pile of missed opportunities.
