Australia’s ABCC argument is not about safety

Australia’s Prime Minister Malcolm Turnbull is on a pathway to an election.  On March 21 2016, the Prime Minister wrote to the Governor-General to continue a convoluted process sparked by the Senate’s refusal to pass laws that will allow the reintroduction of the Australian Building and Construction Commission (ABCC).  One of the justifications for the need to pass the laws is to improve workplace safety, as in the excerpt below for the Prime Minsiter’s letter.  This position is unjustified.

Safety is the first agenda item but the last consideration

It is a common business activity to include Safety as an agenda item in all meetings.  This is intended to show that a company sees Safety as an integral component of all business decisions. But such an action can also be used to dismiss Safety by those who do not see it as related to production or the production program.

Some years ago I was an occupational health and safety (OHS) adviser for a client on a construction project. The project had Safety as the first item of business on the weekly progress meeting.  I was invited to attend and contribute.  The Project Manager opened the meeting, asked if anyone had a “Safety Share”, and then advised that the project had had no incidents in the previous week.

Master Builders keeping up with tech changes in safety

MBA-Poster2On February 2016, the New South Wales division of the Master Builders of Australia (MBANSW) launched a new mobile app that applies augmented reality (AR) to access safety information related to construction sites.  The software has the capacity to access safety information in the form of videos, text, documents and internet links that can put occupational health and safety (OHS) information into the hands of workers.

There is great potential in this software application and the MBANSW should be acknowledged for supporting a technology that is still in its early development but offers an additional way of accessing important occupational health and safety information at the place where may be most needed – in the hands of workers.

But the app is not the answer to everything and, thankfully, MBANSW never claimed it was.  There are technical and organisational limitations to the app but it is a very good start.

Safety is the highest priority. Really?

Workplace safety can have a bizarre logic.  A recent example can be seen in the continuing controversy about the deaths of two workers on a construction site in Western Australia.

In November 2015 two workers Joe McDermott and Gerard Bradley were crushed to death by a concrete slab while on a break at a Jaxon Construction site in East Perth. The Construction Forestry Mining and Energy Union (CFMEU) concerns about the site have been discussed on ABC television last week and on the union’s social media. WorkSafe WA is investigating.

Some of the statements by Kim Richardson, the construction director of the Master Builders Association of Western Australia (MBAWA) seem ill-timed but reflect many of the perspectives held by employers towards occupational health and safety (OHS).

Shortly after the the incident Richardson stated that

“All workers have the right to go to work and have the expectation and the right to come home safely,…. That did not happen.

There’s been a move to have a tremendous amount of paperwork where people will tick boxes to say they have a safe system in place. But that doesn’t guarantee safe systems of work. The way the work is performed is where the focus needs to be.”

Richardson’s complaints seem to be that

  • occupational health and safety has too much paperwork
  • the paperwork misrepresents the level of safety at the workplace
  • greater attention should be given to how work is performed.

Few OHS professionals in Australia would argue these points but there are some uncomfortable implications in these complaints.

Political disregard for OHS…. again

In 2014 during an election campaign (now Premier of Victoria) Daniel Andrews stated:

“Labor will introduce random breath testing for all Members of Parliament during sitting weeks” and

“Labor will also legislate to give the Chief Justice, the Chief Judge and the Chief Magistrate the power to require these random tests of the judiciary.”

At the time potential drug and alcohol testing on Victorian construction sites was topical.

This week the first pledge was dropped and the second was obfuscated.  Where was the safety justification for this pledge in the first place? What was Andrews thinking?

Trade Union Royal Commission shows exploitation of OHS

cover of V1-IntroductionIn January 2015, this blog said of Australia’s Royal Commission into Trade Union Governance and Corruption (TURC):

“Workplace safety has not been the focus of this Royal Commission but it is one of its victims”.

The Royal Commission’s final report was released on 30 December 2015, and it is time to look at the mentions of occupational health and safety (OHS), at least in Volume 1, and see how processes, decisions and reporting in the safety sector may change.

EU provides clues for improving safety management

Cover of ef1551enThe European Union conducts research into occupational health and safety that, although there may be cultural and legislative differences, deserves attention from outside that geographical region.  Recently EuroFound released its annual review for 2014.  There are a couple of research projects that deserve consideration, particularly return-on-investment in construction safety, violence at work, psychosocial issues and precarious work risks.
