Not even lip service to OHS

Australia currently has a lot of official inquiries into workplace issues that affect the occupational health and safety (OHS) of workers.  It is almost impossible to keep up with them and, as a result, some important voices are being missed, but even if they spoke, there is a strong chance they will not be listened to. The Victorian Government has released the final report of the Inquiry into Penalty Rates and Fair Pay.  There are two overt mentions of OHS that don’t seem to go anywhere.

Families of the Dead speak to government

Last time we looked at the Australian Senate Inquiry into “The framework surrounding the prevention, investigation and prosecution of industrial deaths in Australia“, various submissions were considered.  The Inquiry is continuing to hold public hearings, the most recent of these provided an opportunity for relatives of deceased workers to present their arguments.  It is an enlightening insight into a pain that few of us will face but also into the struggles of many to effectively enforce workplace health and safety with, and without, Industrial Manslaughter laws.

Paula Schubert was bullied before her suicide

In November 2016, 53-year old Paula Schubert hanged herself. On July 25 2018 the Northern Territory Coroner Greg Cavanagh described the behaviour of managers at her employer, the Norther Territory Department of Children and Families/Territory Families as bullying.

The full Coronial Findings are an important read for any organisation to understand how managerial activities and attitudes can negatively affect workers.

What Boland’s Independent Review has been hearing

On July 19 2018, Marie Boland, who is conducting an independent review into Australia’s work health and safety (WHS) laws, spoke at the Closing The Loop conference, hosted by the Self Insurers of South Australia (SISA).   Boland’s inquiry has been a little quiet as it undertakes its consultation and investigation but Boland provided some insight at the SISA conference.

Industrial Manslaughter laws remain muddled

The Australian trade union movement is confident that Industrial Manslaughter laws will be introduced in each Australian State and Territory over the next few years.  Recently the Australian Broadcasting Corporation’s Law Report program looked at these laws and their discussion in the current Senate Inquiry into “The framework surrounding the prevention, investigation and prosecution of industrial deaths in Australia“.

Much of the radio program contains a general discussion about workplace fatalities with agreement that the long term trend in workplace fatalities is downwards.  But no one seems to know the reason for this trend.

Focus on safety rather than the Standard

Recently the Safety Institute of Australia (SIA) published an opinion piece about the new international Standard for Occupational Health and Safety Management Systems, ISO45001.  The article professed to answer the question “what does ISO 45001 mean for OHS professionals?” Below is the SafetyAtWorkBlog’s response to that question based on the points raised by the SIA.

The SIA’s Roland Tan states that ISO45001

“provides an opportunity to benchmark with global best practice in managing OHS risks and initiate opportunities to improve OHS performance.”

Australian OHS professionals need to ask whether their clients need to benchmark globally. If not, how is ISO45001 relevant?  It is not.  You would be wasting everyone’s time.

OHS outcomes of ACTU Congress 2018

Below is the list of occupational health and safety (OHS) issues for the next three years, put to the Australian Council of Trade Unions and passed, at its Congress on 18 July 2018.  Some were expected but others will cause concern, primarily, for business owners.  Perhaps the major concern is that these commitments are to be rolled out nationally.
