A closer look at the positive duty to prevent sexual harassment

The big occupational health and safety (OHS) news in Australia has been the release of the federal government’s response to the Respect@Work report on sexual harassment in Australian workplaces. And the biggest issue in that response seems to be the government’s lack of enthusiasm for a major recommendation of Sex Discrimination Commissioner Kate Jenkins, the inclusion of a positive duty in the sexual discrimination legislation. Many lawyers have been asked for their opinions on the government’s response, but very few OHS professionals.

A traditional farm safety campaign with tweaks

For the last few years, farm safety has been dominated by arguments over the safety of quad bikes. Squabbles continue in Australia, but that topic is largely over, and many are returning to a broader and more contemporary approach to health and safety in farming.

It looks like WorkSafe Victoria has begun to roll out its farm safety ambassadors with Catherine Velisha on the cover of a recent edition of Stock and Land newspaper and in a Youtube video. This is supported by a full article on page 3 with an additional article in a glossy supplement provided with WorkSafe’s support.

The article is a blend of promotion for Velisha’s farm management training company and media releases from WorkSafe Victoria. The occupational health and safety (OHS) statistics are new but not very different from previous statistics. Middle-aged men continue to be a feature of the fatality statistics, and 58 on-farm deaths happened in 2020, the same as the year before. Quad bikes have been a major factor in those deaths.

What Australia can learn from other Parliaments about sexual harassment and assaults

Brittany Higgins alleges that she was raped in her employer’s office by a work colleague after a night of drinking. Since mid-February 2021, other women have claimed to have been sexually assaulted in Parliament. The Attorney-General, Christian Porter, is taking some leave after revealing himself to be the person behind historical rape allegations. At the moment, Australian politics is wrapped up in itself over these scandals. Still, similar scandals have happened in other Parliaments, and the responses to these may provide guidance for Australia.

A small survey of female parliamentarians and staff in Europe in 2018 found the following

▪ 85.2 per cent of female MPs who took part in the study said that they had suffered psychological violence in the course of their term of office.
▪ 46.9 per cent had received death threats or threats of rape or beating.
▪ 58.2 per cent had been the target of online sexist attacks on social networks.
▪ 67.9 per cent had been the target of comments relating to their physical appearance or based on gender stereotypes.
▪ 24.7 per cent had suffered sexual violence.
▪ 14.8 per cent had suffered physical violence.

WorkSafe Victoria intends to change the farm safety culture

WorkSafe Victoria has launched a new campaign about health and safety on farms. Safety and health in this sector needs constant promotion as high rates of death and serious injury persist. The latest video campaign deserves a broad audience and hopefully is pushed heavily on television in rural areas and through local newspapers (what’s left of them) as these media continue to be major influences.

Farming is one of the hardest industries in which to achieve tangible change in occupational health and safety as discussed only recently on this blog. This latest campaign is fresh and looks good but the message is confusing if, as WorkSafe Victoria claims, the aim is to affect cultural change in the agriculture sector. The video takes a narrow focus on the male farmers implying they are the major cause of injuries. (Gender is a sensitive issue in farming, even though the statistics show older male farmers continue to be at high risk of injury) There is a little bit of “blame the worker” which is contrary to most strategies for cultural change.

The PM expects Australian workplaces to be “as safe as possible”

Prime Minister Scott Morrison has set the occupational health and safety (OHS) bar unachievably high for Australian businesses.

Morrison is embroiled in a scandal about an alleged rape in a ministerial office, his knowledge of and response to it, and his government’s duty of care to political employees. Below is his response to this question from a journalist:

JOURNALIST: “What is your message to young women who might want to get into politics and see this and are just horrified by it. What’s your reassurance to them about getting involved in the Liberal party or other parties? “

Parliamentary culture must change

Australia is in the midst of a murky investigation into an alleged rape that occurred out-of-hours in an office of a Federal Minister in Australia’s Parliament House. The incident has raised discussions and debates about workplace culture, the reporting of crimes, the uniqueness (?) of the parliamentary workplace, the rights of women, the role of the media in reporting the allegations or in being complicit in the workplace culture…….

Prime Minister Scott Morrison has got himself into a pickle about how to respond, how to investigate and what he should have known and what he was expected to do. One of the actions that he and his government could do, and should have done, was to accept, and act on, the findings of the National Inquiry into Sexual Harassment in Australian Workplaces conducted by the Australian Human Rights Commission (AHRC) early last year. The relevance of this report is obvious:

Business continuity planning by another name

Occupational health and safety (OHS) gets a mention in a full-page advertorial in the Australian Financial Review (AFR) (February 3 2021, page 33) revolving around the legal and business services of Clyde & Co. The advertorial contains a good example of the contemporary business jargon such as “organisational resilience” – a concept that has come to the fore during the COVID-19 pandemic.

“Organisational resilience” has several definitions but here is one used by the British Standards Institution:

“….the ability of an organization to anticipate, prepare for, respond and adapt to incremental change and sudden disruptions in order to survive and prosper.”

This has very strong similarities to the much longer-established concepts of “business continuity” or sustainability within which OHS has dabbled for decades.
