WorkSafe Victoria provides insight into bullying investigations

It has been known for some time that OHS regulators struggle with handling reports of workplace bullying.  Investigation of these hazards requires new inspectorate skills and take considerable time.  Investigations of bullying involve people and this is always more involved than inspecting a missing machine guard or assessing the operation of a forklift.  However, in an article in the Fairfax media on 24 July 2011 WorkSafe Victoria provides some surprising statistics that show a new perspective on workplace bullying and a contrast to recent statistics from Comcare.

The most significant statistic is that, of the 6000 reports of workplace bullying within the last 12 months, only 600 warrant further investigation and, of those, around 60 generate a physical inspection of the workplace.  These statistics may indicate a range of issues:

  • OHS regulators require greater number of inspectors.
  • Workplace bullying is being critically misunderstood by the community.
  • Workers are confused about where to report their treatment and choose WorkSafe as the agency with the highest profile for workplace issues.
  • Other workplace-related agencies and authorities, such as Fair Work Australia and the Australian Human Rights Commission, need to raise their profiles on this issue.
What is missing from the WorkSafe statistics above is the next level of intervention.  What action is being taken by the inspector?  Will prosecutions occur?  Are improvement notices applied?  There may be just as wide a gap between the 60 inspections and an appearance in court.

Safety Institute expulsion raises questions about fairness

John Lambert has been expelled from the Safety Institute of Australia (SIA).  This is a fact that the SafetyAtWorkBlog would not usually report on due to privacy concerns but Lambert has already brought his expulsion to the attention of his occupational health and safety colleagues through various online discussion forums and has agreed to answer the questions below.

A quick background to his expulsion is that there was considerable debate in some sections of the Safety Institute of Australia about disciplinary action being taken against a Victorian Committee Member, Phillip Kamay.  Many members, including John Lambert, saw an injustice and expressed opinions and advice, often, in email and on SIA discussion forums.  It appears that Lambert overstepped the boundaries of criticism in some correspondence and complaints were lodged with the SIA

The National President of the Safety Institute of Australia, Sue Pilkington, has repeatedly promised answers to five questions about John Lambert’s expulsion for almost two weeks.  No answers have yet been received but will be incorporated into this blog posts, if, and when, received.

Directors Sentiment Index mentions OHS but……

The survey results of the inaugural Directors Sentiment Index have been around for several months but recent breakfasts discussing the findings have generated renewed media interest.

The survey provides a useful profile of how directors see their role and lists forecasts of trends but in none of the recent media reports does workplace health and safety receive attention although it is mentioned in the survey results.

The survey, conducted for the Australian Institute of Company Directors (AICD), lists occupational health and safety (OHS) as one of the components of what is described as Environmental, Social and Governance (ESG) issues (page 64).

(Curiously “Work Health & Safety” continues to be abbreviated to OH&S showing the persistence of OHS).

The chart shows that 54% of respondents believe that the importance of OHS issues will increase a little.  This can be interpreted in many ways – directors do not know what they are talking about,  the OHS profession has a bloated sense of its own importance, a survey over time may provide a better reflection of perception or that the work of Safe Work Australia on OHS and corporate governance is not gaining traction on the agendas at board meetings. The best workers’ compensation option is prevention.

The CEO of South Australia’s WorkCover Corporation, Rob Thomson, has participated in a long interview with the online newspaper inDaily on 1 June 2011.  In the article Thomson addresses many of the recent criticisms of his organisation and the sole WorkCover agent, Employers Mutual Limited, but a telling OHS comment occurs in the last couple of paragraphs of the article:

“He took a simplistic approach to changing the culture and performance of the corporation, he said.
“What I am really trying to say is you need to get the right medical treatment and support for people if they are injured, and the best option is prevention.
“To me prevention is ultimately what this is all about. The fewer claims there are, the better it is for the employer, the worker, the rest of society.”

It is very positive that a CEO emphasises the importance of preventing injuries and it will be very interesting to watch the prevention initiatives that the WorkCover Corporation instigates.  It is hoped that Rob Thomson is not thinking about the Commercial Kitchens Campaign that he recently launched.  Continue reading “The best workers’ compensation option is prevention.”

The Commercial Kitchens Campaign needs further examination

Why is a government workers’ compensation agency promoting first aid when a different agency has had that role for over twenty years?  And why do the program’s first aid kits contain commercial products that are no more effective in the first aid treatment of burns than water from the tap?

On May 12 2011, WorkCover SA launched, in conjunction with the Julian Burton Burns Trust, the Commercial Kitchens Campaign.  Burns are a major feature of this campaign with 500 Commercial Kitchens Burns Packs being distributed free to restaurants and cafes in South Australia.

SafetyAtWorkBlog has been told that these kits contain a Burns First Aid Kit developed by A/Prof John Greenwood, the Julian Burton Burns Trust and St John Ambulance Australia which includes the following items:

  • burnaid gel
  • burnaid dressing,
  • a plastic sheet,
  • sterile towel,
  • tape, and
  • step by step directions written by A/Prof John Greenwood.

The odd thing about this initiative is that medical research has shown that burnaid gels are less effective than cool running water for the first aid treatment of burns.  In the journal Wound Practice and Research (Vol 18 Number 1 – Feb 2010) Australian researchers Leila Cuttle and Roy M Kimble wrote in “First Aid treatment of burn injuries” that

“The widespread use of such dressings [Burnaid is specifically referenced] (which have now even penetrated the first aid market) is alarming considering the lack of studies which support their use.” Continue reading “The Commercial Kitchens Campaign needs further examination”

CEOs go undercover over workplace safety

The new initiative of Worksafe Victoria, placing CEOs undercover in their own workplaces, is a major change of direction and should produce a considerable amount of attention.

The online campaign, called The Skeleton Project, ostensibly applies the “Undercover Boss” concept to musculoskeletal injuries (MSIs) and workplace safety more generally. Elsewhere SafetyAtWorkBlog has mentioned that the “undercover Boss” concept is a realisation that CEOs and other senior executives have allowed themselves to become out of touch with the real world working environment of their companies or that the corporate management structure pushes executives into isolation however there are many positives in getting “out and about” as the CEOs in the new campaign do.

WorkCoverSA CEO faces hard tasks as new report damns WorkCover’s performance

Late April 2011 is becoming a period of turmoil in the South Australia’s WorkCover Corporation, on top of the government’s political turmoil from the sudden resignation of the Industrial Relations Minister, Bernard Finnigan, and a minister being charged with child pornography offences.  According to inDaily on 21 April 2011, WorkCover’s Deputy CEO, Jeff Matthews, and Chief Financial Officer, Ian Rhodes, left the organisation suddenly.  CEO Rob Thomson (ex-Workcover New South Wales) says that the positions were axed as part of a restructure.

On 27 April 2011, the most recent review into WorkCover’s operations was released.  The March 2011 report finds that the state’s workers compensation scheme
