OHS is not all about workers compensation data

Every couple of months, after the release of official workplace fatality figures and serious injury, the Australian media reports the three most dangerous industries as Agriculture, Fishing and Forestry.  The latest article appeared in Australia’s Fairfax Media on 17 January 2018.  It is good that occupational health and safety (OHS) is gaining attention.  When so little media attention is given, any publicity is useful.

However this type of article also presents some negatives, including that it may be only representing 60% of all workplace fatalities and serious injuries.

Victoria joins the push for licencing labour hire

Victoria is the latest Australian State to introduce laws into Parliament that establish a licencing scheme for labour hire operators. The Labour Hire Licensing Bill 2017 was read into Parliament on 14 December 2017 (Hansard, pages 55-61)

The Bill is compatible with the laws passed recently in Queensland and South Australia which apply a universal licencing scheme rather than a sectoral one as preferred by some organisations.  This should make the scheme easier to administer as it removes demarcation disputes and, as pointed out by the Minister for Roads and Road Safety, Luke Donnellan, removes loopholes of opportunity for avoiding obligations – a critical consideration in a sector that has shown such disregard for legal obligations. ACCC releases Issues Paper to start public quad bike safety consultation

The Australian Competition & Consumer Commission (ACCC) has released an issues paper on quad bike safety with a deadline for public submissions of mid-December 2017.  An ACCC spokesperson has advised that submissions will be made available to the public through the website unless privacy and confidentiality is requested. A draft recommendation is scheduled for early 2018 with a final recommendation in mid-2018.

Issues papers serve two purposes – the provision of information and questions of particular importance.  This article will look at some of those questions.

New OHS statistics expand our understanding of work injuries and mental health

On November 9 2017, the Australian Institute of Health and Welfare (AIHW) released statistical data on work-related injury.  This data included statistics from workers compensation but also statistics about hospitalised injuries that were identified as work-related but funded by sources other than workers’ compensation.  The report also provides a different perspective on mental health.

Extraordinary, quiet, policy change at WorkSafe Victoria

In April 2017, WorkSafe Victoria created consternation in the farming sector by stating that farmers who own quad bikes must fit operator protection devices (OPDs) to the vehicles in order to operate them safely. The quad bike manufacturers took WorkSafe Victoria to the Supreme Court and, according to various media statements, the issue was dismissed before getting to Court and everybody won! On 26 October 2017, the current policy position of WorkSafe Victoria on operator protection devices (OPDs) was clarified.

New quad bike safety taskforce has a mid-2018 deadline

On 24 October 2017, Australia’s Ministers for Employment and Small Business announced a new taskforce led by the Australian Competition and Consumer Commission (ACCC) that will conduct an investigation into quad bike safety.  What is different about this taskforce is that it is

  • a Federal taskforce,
  • looking at the introduction of a “quad bike product safety standard”, and
  • coordinated by the ACCC drawing on the experience of State and Federal workplace safety authorities.
