HR, welcome to the OHS world and start getting used to it

In an article on burnout in The Sydney Morning Herald and The Age on December 10 2022 (paywalled), there was a peculiar quote and some paraphrasing of Sarah McCann, chief executive of the Australian Human Resources Institute (AHRI), indicating the size of the challenges facing human resources professionals in preventing psychosocial harm in Australian workplaces.

The article is a peculiar one. It states that burnout has been categorised as an occupational risk by the World Health Organisation but then reports on psychological support organisations who are applying the concept outside of work activities. The justification for this is that the work undertaken at home or in caring for a family is unpaid work but still work, so the occupational definition applies. That’s a stretch, but it’s possible.

Engineering controls are possible, and they save lives

The issue of quad bike safety has largely disappeared from the mainstream media. This is largely due to the decline in opposition to installing Crush Protection Devices (CPD) on newly-purchased quad bikes in line with the Australian Competition and Consumer Commission (ACCC) mandated safety standards. On November 24 2022, the ACCC released statistics that showed the success of applying an Engineering Control (the CPDs) favoured by the safety advocates over the Administrative Controls (training, signage and dynamic riding) favoured by the manufacturers and their lobbyists.

The quad bike safety saga in Australia, in particular, is a textbook study of farm politics, globalisation, belligerence, the ownership of evidence, the macho culture of independence, manipulation of consumers, ineffective politics, ineffective occupational health and safety (OHS) arguments, the power of money and more. (There’s an important book challenge to anyone who has the time and the resources)

More OHS activists needed

The Australian Government is set to introduce new workplace sexual harassment laws and obligations through Parliament. In The Saturday Paper on November 5 2022 (paywalled), businesswoman Lucy Hughes Turnbull wrote a short article that reminds us of the purpose of the new laws.

“The whole idea of the Me Too movement and the Respect@Work report was to make workers safer. So it was surprising that the politicians who resisted some of the Jenkins recommendations are often the ones most willing to drape themselves in worker safety gear. Protection from abuse and harassment is another key aspect of safety, like guardrails and fire exit signs. Now the legal system recognises it as such.
This latest work safety bill is the best gift the parliament could give to mark the fifth anniversary of the global Me Too movement. Together with more paid parental leave and greater access to more affordable childcare, it has been a great few weeks for women and indeed all Australians.”

Do we have to work?

You often learn more about your area of speciality from reading outside of that speciality. Matthew Taylor’s book “Do We Have To Work?” is one of those books though it overlaps with occupational health and safety (OHS), if one thinks of the role and place of OHS in modern business.

The Big Idea series of books by Thanes & Hudson uses a jaunty format that is jarring in some ways but attractive in others. Its pages use fonts of different sizes, lots of colour images and highlighted cross-references that look like a Dummies Guide on acid, but the content is so good the reader works out where to look and what to choose fairly quickly.

Governments could improve their OHS performance if they wanted

In 2019, the head of SafeWork South Australia, Martyn Campbell, told this blog that he agreed that government departments should be exemplars in occupational health and safety and that “we should be the pinnacle of safety professionalism and leadership”. It should not be a surprise to hear the head of an OHS regulatory agency claim this, but the origin of the question to Campbell stemmed from a review of Victoria’s OHS Act by Chris Maxwell QC in 2004.

Given the recent OHS-related scandals in various jurisdictions, which have often been related to the management of the coronavirus pandemic, it is worth reminding ourselves of the OHS performance standards that Maxwell advocated for all government departments and agencies.

Sacking may eliminate a hazard but allow toxic work cultures to persist

A Queensland inquiry into how Police respond to and handle domestic violence incidents has gained an occupational health and safety (OHS) context. According to The Guardian newspaper (paywalled).

“Employment law experts say the weak police discipline system and the ongoing employment of problematic officers have created “clear breaches of duty” under workplace health and safety laws, which require organisations to provide a safe environment for employees.”

Perhaps the article is more telling in the assumption that offending Police are unredeemable, with the only option being to sack them. OHS duties are meant to be supportive, but they also advocate that workplace hazards should be eliminated, as this is the most effective risk control measure.

Two OHS regulators under investigation

Almost all the government agencies that regulate occupational health and safety (OHS) in Australia have been subjected to various independent inquiries. These inquiries have been a mix of political, financial and cultural. The review of SafeworkSA closes submissions at the end of this week. SafeWorkNSW is to have a six-month audit (paywalled) of its performance by the NSW Auditor-General, according to Adele Ferguson in the Sydney Morning Herald.

The Auditor-General is yet to release a media statement on the audit, but Ferguson identifies several serious concerns.
