Near miss incidents are the best opportunities from which to improve safety

One of the most frustrating parts of being a safety professional is that “near misses” or “near hits” or “close calls”, as some refer to them, are often neglected even when these events are often the best to investigate as no one was directly injured.

The significance of the near miss may be illustrated by a court case and penalty from South Australia on 28 July 2011.  The media release states that Kyren P/L was fined over $A40,000 after a dogbox fell over 30 metres without anyone being injured. (The full court decision is available online)

“In August 2008 at a building site in Coglin St. Adelaide, an attempt to lift a fully-laden work box (known in the industry as a ‘dog box’) to the seventh floor ended catastrophically when the tower crane failed sending the dog box into a 30-metre freefall. It landed in the laneway separating the site from an adjoining business.  A plastic bin beneath was crushed.  Some hoarding was damaged, and there was minor structural damage to the guttering of a neighbouring building which housed a law firm.

WorkSafe Victoria provides insight into bullying investigations

It has been known for some time that OHS regulators struggle with handling reports of workplace bullying.  Investigation of these hazards requires new inspectorate skills and take considerable time.  Investigations of bullying involve people and this is always more involved than inspecting a missing machine guard or assessing the operation of a forklift.  However, in an article in the Fairfax media on 24 July 2011 WorkSafe Victoria provides some surprising statistics that show a new perspective on workplace bullying and a contrast to recent statistics from Comcare.

The most significant statistic is that, of the 6000 reports of workplace bullying within the last 12 months, only 600 warrant further investigation and, of those, around 60 generate a physical inspection of the workplace.  These statistics may indicate a range of issues:

  • OHS regulators require greater number of inspectors.
  • Workplace bullying is being critically misunderstood by the community.
  • Workers are confused about where to report their treatment and choose WorkSafe as the agency with the highest profile for workplace issues.
  • Other workplace-related agencies and authorities, such as Fair Work Australia and the Australian Human Rights Commission, need to raise their profiles on this issue.
What is missing from the WorkSafe statistics above is the next level of intervention.  What action is being taken by the inspector?  Will prosecutions occur?  Are improvement notices applied?  There may be just as wide a gap between the 60 inspections and an appearance in court.

Back support devices don’t work but new designs should be investigated

In 2009 Australian OHS regulators made the definitive statement on the use of back belts.  The guidance stated that:

  • Back belts don’t reduce the forces on the spine
  • Back belts don’t reduce the strain on muscles,tendons and ligaments
  • Back belts do nothing to reduce fatigue or to increase the ability to lift
  • Back belts are like holding your breath when lifting
  • Back belts can increase blood pressure and breathing rate
  • Back belts don’t reduce the chance of injury or reduce back pain.

This was a terrific example of evidence-based safety.  But this does not mean that the use of back belts should not be reconsidered if there is new evidence or new back belt designs.

One SafetyAtWorkBlog reader has drawn our attention to a new type of back support, The Tolai All Purpose Back Support.  In no way does this blog support this particular device.  In fact, there is a strong argument against the widespread use of such devices as these may advocate the reliance on PPE (personal protective equipment) rather than a higher order of control, such as task redesign, which would result in a more sustainable solution.

The European experience with economic incentives for OHS improvements

Last decade the New South Wales government operated a “premium discount scheme” intended to reinvest workers’ compensation funds into preventative safety measures and programs.  Other OHS jurisdictions had a similar authority but chose not to apply it.  Since then economic safety incentives have not been on the political agenda. 

However this is not the case in other parts of the world.  In 2010, the European Agency of Safety and Health at Work undertook a review of economic incentives (“Economic incentives to improve occupational safety and health: a review from the European perspective”).  Those findings may be worth considering in light of some of the political changes on incentives in other areas of public policy, such as carbon taxes.

From outside the European Union, the comparative charts of member schemes are of less interest than the literature review and report conclusions.  The incentives that the report says have some positive benefits include

Occupational Medicine provides OHS clues

Medical research rarely provides definitive answers to occupational hazards.  What research provides are clues.  These clues lead to additional research which, over time, can generate answers and solutions.  But OHS specialists often do not have the luxury of waiting for an answer before taking some action to reduce risk and harm and often the clues are enough to take action or at least begin planning that action.

The Journal of the Society of Occupational Medicine is a treasure trove of clues.  Below are some of those clues that may help OHS professionals in controlling hazards and anticipating others.

Man flu and stress

One team of researchers in Korea[1] has identified

“Males experiencing work stress in job demand, job control and social support reported an increased occurrence of the common cold at follow-up but this association was not seen in females.”

As stress is an increasingly important element of workplace health and safety, this research indicates that what some are dismissing as “man flu” may have some validity as stressor indicators.  Continue reading “Occupational Medicine provides OHS clues”

Government must restructure to address the evolution of OHS

The UK government’s Health & Safety Executive is continuously countering poor decisions of local government that are being “blamed” on health and safety.  Recently the Wimbledon tennis open joined the club of misrepresenting risk decisions as health and safety.

England has a unique tabloid journalism that has generated substantial confusion on the role and application of occupational health and safety laws.  Most of the decisions being referred to as health and safety are really public liability concerns and this is where the risk management discipline enters the issue.  Occupational Health and Safety has enlisted the risk management principles to provide a structure for business to assess risk, costs and benefits of working safely.  However this has only worked when there was a clear delineation of workplace.

Over many years, OHS legislation has been allowed to broaden its remit from the shopfloor and factory fence to include those entering a workplace and visitors.  It then grew to include the impacts that any work activity may be having on others.

In Australia, the new definition of a workplace is anywhere where work is undertaken.  The OHS tentacles have penetrated all physical areas of society, although he police force has been struggling with this balance for years.  There is nothing occupational about OHS anymore.  In fact Australia will be dropping “occupational” from its Work Health and Safety legislation from 1 January 2012.  There have been sound reasons for this expansion but we now have to live with the consequences. Directors Sentiment Index mentions OHS but……

The survey results of the inaugural Directors Sentiment Index have been around for several months but recent breakfasts discussing the findings have generated renewed media interest.

The survey provides a useful profile of how directors see their role and lists forecasts of trends but in none of the recent media reports does workplace health and safety receive attention although it is mentioned in the survey results.

The survey, conducted for the Australian Institute of Company Directors (AICD), lists occupational health and safety (OHS) as one of the components of what is described as Environmental, Social and Governance (ESG) issues (page 64).

(Curiously “Work Health & Safety” continues to be abbreviated to OH&S showing the persistence of OHS).

The chart shows that 54% of respondents believe that the importance of OHS issues will increase a little.  This can be interpreted in many ways – directors do not know what they are talking about,  the OHS profession has a bloated sense of its own importance, a survey over time may provide a better reflection of perception or that the work of Safe Work Australia on OHS and corporate governance is not gaining traction on the agendas at board meetings.
