Is the Senate a workplace?

Recently Australian media was entranced with an argument over gender politics between two Senators, David Leyonjhelm and Sarah Hanson-Young.  One of the elements in the argument concerns sexual harassment in the workplace but is the Australian Parliament a workplace like any other Australian workplace? And does this really matter?

In the aftermath of the initial argument, Prime Minister Malcolm Turnbull said:

“David Leyonhjelm’s offensive remarks should have been withdrawn the moment they were uttered and he should have apologised. And it’s not too late for him to withdraw and apologise.

That type of language has no place in Parliament and it shouldn’t have a place in any workplace. We have to treat each other with respect, we must do that. Respect for women in particular is one of the highest priorities that we should be focused on. I just want to be very clear about this.

It is a, you know, we often talk about domestic violence and our concerns there and all the measures we’re taking to address it. I just want to say this, it’s a reminder to everybody that not all disrespecting women ends in violence against women, but that is where all violence against women begins. So you need to have respectful workplaces where we treat each other with respect. Where we disagree, we disagree in respectful language……” (emphasis added)

Exclusive reports from the 2018 ACTU Congress

SafetyAtWorkBlog will be reporting from the biennial Congress of the Australian Council of Trade Unions. For the first time   Trade unions have been pivotal for the creation and enforcement of occupational health and safety (OHS) around the world.

Most of the past reporting on these events in mainstream media has focused on politics and industrial relations.  OHS tends to get overlooked so SafetyAtWorkBlog’s attendance will be important.

Still treating the symptoms of mental health

Suicide prevention continues to be a growth area in rainsingfund-raising and awareness raising.  On 17 May 2018, Prime Minister Malcolm Turnbull released a video supporting a treadmill challenge in support of suicide prevention.  It seems an odd campaign when there have been various walks and other events in the past that have more of a public statement that being on a treadmill in a gym.  But this is not the only odd suicide awareness event.  Last week, Winslow Constructions had a program launch that was also a little odd and a campaign that is worthwhile, as far as it goes.

In May 2018, Winslow Constructions held a media event on one of its residential construction projects to the north of Melbourne.

The people deserve more respect from their politicians

According to Hansard, Western Australia’s Opposition Minister for Local Government, Tony Krsticevic put a Question on Notice to the Government about WorkSafe WA’s activities and meetings in relation to the City of Perth. The Council is currently undergoing an independent inquiry into its governance and workplace behaviours.  The investigation is scheduled to take 12 months.

Why are we arguing about Industrial Manslaughter laws?

On the issue of Industrial Manslaughter laws, Lana Cormie (pictured far right) said:

“Employers need to have motivation to do the right thing, ’cause clearly they don’t do it off their own back.  So, if that means, if this’ll be the difference between them making OH&S a high priority and not, then it needs to be done.  And I think all the other benefits for the men on the ground, and the women on the ground, will filter down from that.  “

Her comments on International Workers Memorial Day emphasises that the introduction of these laws is not so much about new laws but the failure of the existing ones and of their application.  Over time, the general commitment to implementing occupational health and safety (OHS) has declined in many workplaces or, at least, has not progressed in the way expected by the safety law makers of the 1970s and 1980s.

Duty of care needs a moral analysis

In my readings on Industrial Manslaughter, a reader recommended a book to help me understand how the world works.  I haven’t found the time to read it through because I get angry and/or depressed, but I wanted to share a suggestion that may help clarify our occupational health and safety (OHS) obligations and provide a reconsideration of the employer’s duty of care.

In “Why Not Jail? – Industrial Catastrophes, Corporate Malfeasance, and Government Inaction“, Rena Steinzor summarised some work by David Luban and others in a research paper called “Moral Responsibility in the Age of Bureaucracy“. Steinzor outlines five managerial duties:

Flogging the banks could help safety

Australia’s Royal Commission into banking and financial services is a few months in and the evidence provided of wrongdoing is so substantial that those who were critical of the need for such an investigation are admitting they were wrong.

SafetyAtWorkBlog is applying the logic that occupational health and safety (OHS) succeeds best when it is part of the organisational culture.  Australia has often held its banking and financial services as “world-class” and many of that industry sector’s leaders have been prominent in speaking about the importance of leadership and corporate morality.

The financial and banking industry’s credibility and authority in Australia is gone and the OHS profession can learn much from this failure, even when the failure is in its early stages of exposure.
